2. Scope, Application and Definitions of these GTC
These General Terms and Conditions (GTC) set out the terms of the contracts concluded for already completed works of fine art sold by the Service Provider through the Webshop. In the Webshop, the Service Provider acts in its own name, on its own responsibility, and as the seller.
Before finalising the order, the customer is required to read and accept the GTC. The GTC become part of the contract. The version of the GTC in effect at the time the order is accepted shall govern the contract.
A consumer is a natural person acting outside the scope of their profession, self-employed occupation or business activity. A natural or legal person ordering for business purposes does not qualify as a consumer; the rights specifically granted to consumers – in particular the statutory 14-day right of withdrawal – do not apply to such a person.
The GTC are available in Hungarian and English. In the event of any discrepancy in interpretation, the Hungarian text shall prevail, provided that this does not restrict the mandatory consumer protection rules applicable under the law of the consumer’s place of residence.
3. Characteristics of the Products
Only already completed, actually available works of fine art, typically existing as a single original copy, may be ordered through the Webshop. These GTC do not cover custom, made-to-order works; such requests may be the subject of a separate agreement.
The product page contains the name of the creator, the title of the work, its technique, medium, dimensions, whether it is framed or unframed, and – if known – the year of creation and other material characteristics. For a framed work, the product page separately indicates the dimensions measured together with the frame.
Product photographs are intended to present the work as accurately as possible. Due to display settings and lighting conditions, shades may vary slightly. Interior lifestyle images are illustrative only; the actual dimensions are determined by the product data.
Every work is accompanied by a certificate of authenticity signed by the artist. The certificate is an accessory to the work and must therefore be returned together with the work in the event of withdrawal or return.
The Service Provider warrants that it is entitled to sell the work, and that the work is free from any third-party ownership rights, liens, claims, or any other encumbrance or claim that would restrict the customer’s acquisition of ownership. The Service Provider further warrants that the work is an original work by the artist indicated on the product page.
Works of art - in particular older works - may have unique condition characteristics resulting from their age, materials, technique or previous treatment. The Service Provider describes, in text and where possible with photographs, on the product page the material condition characteristics, wear, surface variations, minor damage and defects known to it. A specific deviation of which the consumer was given prior, separate notice, and which the consumer accepted during the order process by way of an express and active statement distinct from acceptance of the GTC, shall not be considered defective performance when the contract is concluded. The general description of condition does not exclude the Service Provider’s mandatory statutory liability.
4. The Ordering Process and Formation of the Contract
Purchases are made without registration, as a guest. The customer places the selected work in the cart, provides the billing and shipping details, selects the available shipping method, reviews the total amount payable, accepts the GTC, and submits the order.
Before sending the order, the customer may correct data entry errors and may modify or delete the contents of the cart. Submitting the order constitutes an offer that gives rise to a payment obligation.
The automatic e-mail sent upon receipt of the order only confirms the technical receipt of the order and does not constitute acceptance of the order. The contract is concluded when the Service Provider accepts the order in a separate e-mail. The Service Provider is entitled to refuse the order for justified reasons - in particular a stock error, a duplicate order, an obvious pricing error, or damage to the work in the meantime - in which case it will refund any amount already paid without delay.
The Service Provider confirms receipt of the order electronically without delay. If this confirmation does not reach the customer within 48 hours at the latest from the sending of the order, the customer is released from being bound by the offer and from any resulting contractual obligation.
The contract qualifies as a contract concluded by electronic means, is concluded in Hungarian or English, is not separately filed by the Service Provider, but the content of the order and the electronic confirmations is accessible to the parties by e-mail.
5. Prices and Payment
The product prices shown in the Webshop are gross consumer prices expressed in euro (EUR) and include the taxes payable under applicable law. The shipping fee is a separate item, which the Webshop displays before finalisation of the order, based on the shipping category of the work and the destination country.
Payment is made exclusively by advance bank transfer, in euro. The e-mail sent regarding the order contains the necessary bank details. The order identifier must be indicated in the payment reference. Any transfer, currency conversion or other fees charged by the customer’s bank are borne by the customer.
The purchase price must be credited to the Service Provider’s bank account within 3 business days from the sending of the payment request. If this does not occur, the Service Provider is entitled to cancel the order and make the work available again.
In the case of an obviously erroneous price - in particular EUR 0 or an amount conspicuously low in relation to the nature of the product - the Service Provider is not obliged to perform at the erroneous price; it may offer the correct price, which the customer may accept or reject.
6. Invoicing
The Service Provider issues an electronic invoice for the purchase through the Billingo system and sends it to the e-mail address provided when the order was placed. By accepting the GTC, the customer consents to the issuance and sending of the electronic invoice. No separate paper invoice is included in the package.
A corporate customer is required to provide the correct company name, registered office and tax number. Within the limits of mandatory law, the consequences arising from incorrectly provided billing data are borne by the customer.
7. Shipping and Performance
No in-person collection is available. The Service Provider undertakes to deliver to Hungary and to the European Union destination countries indicated in the Webshop. Destination countries planned to be available at launch: Austria, Belgium, the Czech Republic, the Netherlands, Poland, Luxembourg, Germany, Slovakia and Slovenia. The current country list is always visible at the Webshop checkout.
The service of Magyar Posta Zrt. (MPL) is available as a selectable shipping method. The specific postal product, the fee, the option of declaring value, and the expected delivery time may vary depending on the size and value of the work and the conditions of the destination country. Before finalising the order, the Webshop displays the available option and its fee.
The Service Provider hands over the properly packaged shipment to the carrier within 5 business days from the crediting of the full purchase price. This is the dispatch deadline; the actual delivery time depends on the carrier and the destination country. The Service Provider will inform the customer of any delay of which it is aware.
Unless otherwise separately agreed, the Service Provider performs the contract within 30 days at the latest from the conclusion of the contract. If performance is foreseeably not possible within this period, the Service Provider will inform the customer without delay, and the parties may agree on a new deadline; this does not restrict the consumer’s statutory rights.
In a consumer sale, the risk of loss or damage passes to the consumer when the consumer, or a third party designated by the consumer, takes possession of the work. In the event of visible damage to the package, the customer should, where possible, request a report from the delivery person and photograph the outer packaging, the inner protective packaging, and the damage to the work. The absence of such documentation does not in itself extinguish the consumer’s statutory claims, but may make it more difficult to pursue a claim against the carrier.
8. Right of Withdrawal for Consumers
The consumer has the right to withdraw without giving any reason within 14 days of receiving the product. Where several products are delivered at different times, the period shall run from the receipt of the last product delivered. The consumer may also exercise the right of withdrawal during the period between the conclusion of the contract and receipt of the product.
The withdrawal statement may be sent by e-mail to info@pannonaris.com or by post to 1039 Budapest, Hadrianus u. 7. The consumer may use the model form set out in Annex 1, but any other unambiguous statement is also acceptable. The deadline is deemed to have been met if the consumer sends the statement before the expiry of the 14-day period.
Within 14 days of communicating the withdrawal, the consumer is required to return or hand over the work and the certificate of authenticity. The direct cost of the return is borne by the consumer. The Service Provider is not obliged to accept a shipment returned cash-on-delivery or with postage due. This does not affect the consumer’s right of withdrawal; the consumer must carry out the return using pre-paid carriage.
The consumer is required to return the work in secure packaging appropriate to its nature and value. The consumer is liable only for any diminished value resulting from handling of the work beyond what is necessary to establish its nature, characteristics and functioning.
9. Refund in the Event of Withdrawal
In the event of a valid withdrawal, the Service Provider will refund the amount paid by the consumer, including the cost of the cheapest standard shipping method offered, within 14 days at the latest from becoming aware of the withdrawal. If the consumer chose a more expensive shipping method, the additional cost will not be refunded.
The Service Provider will make the refund in euro, using the same method of payment as the original transaction, unless the consumer expressly agrees to a different method that does not result in any additional cost to the consumer. The Service Provider may withhold the refund until it has received the work back, or until the consumer has credibly demonstrated that the work has been returned, whichever occurs earlier.
10. Defective Performance and Warranty for Defects
The Service Provider performs defectively if, at the time of performance, the work does not meet the quality requirements set out in the contract or by law. A characteristic, natural material phenomenon, prior condition or deviation that the product page clearly presented before the purchase and that the customer expressly accepted shall not be regarded as a defect.
In a consumer contract, under the applicable law the consumer may primarily request that the goods be brought into conformity with the contract. Since the works are typically unique items, replacement is generally impossible. Depending on the circumstances, repair or restoration, a proportionate price reduction, or termination of the contract with a refund of the purchase price may apply. The order, conditions and time limits for these rights are governed by the Civil Code (Ptk.) and Government Decree 373/2021 (VI. 30.).
The consumer should report the defect without delay after discovering it. A defect reported within two months of discovery is deemed to have been reported without delay. The warranty rights of customers purchasing for business purposes are governed by the general rules of the Civil Code.
The works do not fall within the scope of durable consumer goods subject to mandatory guarantee; this does not affect the warranty for defects or other statutory rights.
11. Complaint Handling
The customer may submit a complaint orally or in writing using the contact details of the Service Provider given in Section 1. For a verbal complaint made by telephone that cannot be resolved immediately, the Service Provider will draw up minutes. The Service Provider will respond to a written complaint in writing, on the merits, and in a verifiable manner, within 30 days of its receipt.
If the complaint is rejected, the response will state the reason for the rejection, as well as which authority or conciliation body the consumer may turn to.
12. Conciliation Board and Enforcement of Rights
To settle a dispute amicably, the consumer may turn to the conciliation board having jurisdiction over their place of residence or habitual abode, or, based on the Service Provider’s registered office, to the Budapest Conciliation Board. The Service Provider fulfils its statutory duty to cooperate in conciliation board proceedings.

The consumer may also initiate consumer protection authority proceedings, or may enforce their claim before a court. The European Union’s former Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025; accordingly, these GTC do not refer to a functioning ODR complaints platform.
13. Copyright and Use of the Works
Acquiring ownership of the physical work does not entail the transfer of the copyright associated with the work. The customer may possess the work, display it for private purposes, and resell it within the scope of ownership, but may not reproduce the work without the rightholder’s permission, may not use it for commercial purposes, may not make prints or other products from it intended for sale, and may not make it available in any manner that infringes copyright.
The content, visual identity, texts and images of the Webshop may be protected by copyright. Use of the Webshop does not grant any licence to use the content for commercial purposes.
14. Data Processing and Electronic Communication
The Service Provider processes the personal data necessary for the performance of the order, invoicing, shipping and complaint handling in accordance with the separate Data Processing Notice. The customer is required to provide a functioning e-mail address and accurate details, and to ensure that they are able to receive electronic messages relating to the order.
15. Liability and Operation of the Webshop
The Service Provider strives for the continuous availability of the Webshop and the accuracy of its data, but short technical faults, maintenance, or outages of external service providers may occur. The Service Provider is not liable for delay arising from an unavoidable event beyond its control, but will inform the customer within a reasonable time of its effect and the expected performance.
This limitation of liability does not apply in cases where the exclusion or limitation of liability is prohibited by law, in particular in the case of intentional damage, a breach of contract causing harm to life, physical integrity or health, or the mandatory rules on consumer rights.
16. Amendment of the GTC and Final Provisions
The Service Provider may amend the GTC with effect for the future. Any amendment does not affect contracts already concluded. The GTC in effect at any given time are available on the Webshop in a downloadable and saveable format.
Matters not regulated by these GTC are governed in particular by the applicable provisions of Act V of 2013 on the Civil Code, Act CVIII of 2001 on Certain Aspects of Electronic Commerce Services, Act CLV of 1997 on Consumer Protection, Government Decree 45/2014 (II. 26.), and Government Decree 373/2021 (VI. 30.).
The parties shall endeavour to settle their disputes amicably. This provision does not restrict the mandatory jurisdiction rules applicable under the law of the consumer’s place of residence.
